DOSSIERS FOR GAME COPYRIGHT REGISTRATION

Game copyright registration helps protect the legal rights of authors and owners, prevents unauthorized copying as well as creates favorable conditions for marketing and distribution of products. During the process of carrying out the prescribed procedures, what should be paid attention to when submitting documents to competent state agencies?

Subjects to implement game copyright registration

Game programs can be registered as computer programs, protected under the copyright group according to the provisions of Intellectual Property law.

Procedures for game copyright registration are carried out by the author, owner or person authorized by the author or owner.

Method of submitting appication dossiers for game copyright registration

Application dossiers can be submitted in person, via postal service or via the online Public Service Portal.

Time limit for processing game copyright registration dossiers

Within 15 working days from the date of receipt of the valid application, the state management agency in charge of copyright and related rights is responsible for issuing certificate of registered copyright for the game.

Components of game copyright registration dossiers

Application for issuance of Certificate of registered copyright for game consists of:

– Application for registration of copyright;

– 2 copies of the works (including electronic copies);

– Power of attorney if the applicants are authorized by authors, copyright holders;

– Proof of copyright ownership;

– Written consent of co-authors, if there are multiple authors;

– Written consent of co-owners if copyright, related rights are under joint ownership;

– If the works contain images of other individuals, written consent produced by these individuals is required as per the law.

Note about the copyright registration declaration in the game copyright registration dossier

The copyright registration declaration is made according to the form prescribed by the Minister of Culture, Sports and Tourism. In there:

– The declaration form must be written in Vietnamese and contains information about the applicant, the author, the owner(s) of copyright or related rights;

– Completion time;

– Summarized content of the work;

– Time, location and form of publication;

– Commitment to take responsibility for information provided in the declaration form.

The declaration must bear the signature or fingerprints of the author, owner of copyright, owner of related rights, unless they are not physically capable of signing or appending fingerprints.

Requirements for game in copyright registration dossiers

Copies of computer programs include CDs containing the computer programs (with a piece of paper containing the name of the computer program stick to one side of the CD) and photocopies on A4 paper containing the entire interface and code of the computer programs.

If printed copies of code of computer programs are at least 100 pages in length, applicants are only required to print the first 25 pages, the middle 25 pages, and the last 25 pages.
