CHANGE ON NAME OF ADOPTED CHILD, ARE ADOPTIVE PARENTS PERMITTED?

Adoption and registration with competent authorities aim to establish a long-term, sustainable and fully legal relationship between father, mother and child. After completing these prescribed procedures, the adoptive parents and adopted child have full rights and obligations of parents and child. 1. Who can adopt?

The purpose of adoption is to ensure that adopted child are raised, cared, and educated in a family environment. Individuals with the right to adopt child include subjects in the following order of priority:

– Step father, step mother, natural aunt or uncle of the adopted person;

– Vietnamese citizens permanently residing in the country;

– Foreigners permanently residing in Vietnam;

– Vietnamese citizens settling abroad;

– Foreigners permanently residing abroad.

2. What conditions must be met to adopt a child?

To be approved to register on adopting a child, the adoptive parents must meet the following conditions:

– Having full civil act capacity;

– Being 20 years or more older than the adopted person;

– Having health, financial and accommodation conditions for assuring the care for and nurture and education of the adopted child.

– Having good ethical qualities.

Note, in cases where a stepfather adopts his wife’s stepchild, a stepmother adopts her husband’s stepchild, or a biological aunt, uncle, or aunt adopts a grandchild, the age regulations (more than adopted children 20 years of age or older) and health, economic, and accommodation conditions to ensure the care, upbringing, and education of adopted children.

3. When adopting, do parents have the right to change on name of adopted child?

According to the provisions of law, from the date of adoption, the adoptive parents and adopted child have full rights and obligations of parents and child; Between the adopted child and other members of the adoptive parents’ family, there are also rights and obligations towards each other.

Correspondingly, the change on name of adopted child can be implemented upon the request of the adoptive parents. However, it should be noted that changing the name of an adopted child aged from 9 years must be approved by that person.

In addition, in case the adopted child is an abandoned child, the child’s ethnicity is determined according to the ethnicity of the adoptive father and adoptive mother.
