CONDITIONS FOR TRANSFER OF MEDICAL EXAMINATION AND TREATMENT BETWEEN SAME LEVEL MEDICAL FACILITIES

In some cases, health insurance participants have the right to transfer between hospitals at the same level, in accordance with their medical condition and the capacity and services of the corresponding medical examination and treatment facility. So what conditions must be met for transfer of medical examination and treatment between medical facilities of the same level?

1. Conditions for the transfer of medical examination and treatment between medical facilities of the same level

The transfer of medical examination and treatment between medical facilities of the same level is performed by the medical facility under the following order:

a. Step 1: Notice on the transfer of medical examination and treatment

Notifying and explaining the patient or his/her legal representative the reasons for transfer of facility.

b. Step 2: Issuance of the slip of transfer

Competent representative of the medical facility shall sign the slip of transfer under specified form.

c. Step 3: Contacting the medical examination and treatment facility where the patient is expected to be transferred

– If the patient needs emergency treatment, the medical facility shall contact with the receiving facility; re-check the conditions of the patient before transferring; prepare vehicles and equipment for providing emergency treatment on the way to the receiving facility;

– If the patient needs technical assistance from the receiving facility, the transferring facility shall provide the receiving facility with information about conditions of the patient and necessary assistance for preparation;

d. Step 4: Handing over documents and patient

– The slip of transfer shall be given to the medical officials going with the patient or the legal representative of the patient to provide for the receiving facility;

– The transferring facility shall transfer the patient and the slip of transfer to the receiving facility.

2. Conditions for the transfer of medical examination and treatment of the same level

Conditions for transfer of patients between medical facilities of the same level:

– The disease is not suitable to the list of techniques of the medical facility approved by a regulatory authority in healthcare or, the disease is suitable to the list of techniques of the medical facility approved by a regulatory authority in healthcare but, due to an objective reason, such medical facility is not qualified to provided diagnosis and treatment;

– The disease is suitable to the list of techniques of the medical facility that is planned to receive the patient that is approved by a regulatory authority.

Medical examination and treatment facilities transfer patients between appropriate hospitals of the same level.

3. Power to sign the slip of transfer

According to current regulations, the power to sign the slip of transfer:

– Regarding public medical facilities: the Head of the medical facility or the person authorized by the Head of the medical facility is in charge of signing the slip of transfer.

– Regarding public medical facilities: the person in charge of professional skills of the medical facility or the person authorized by him/her is in charge of signing the slip of transfer.

– In a shift, the leader of the team is in charge of signing the slip of transfer.

  • Law on Health Insurance 2008 (amendment and supplement on 2014);
  • Decree 146/2018/ND-CP guiding the Health Insurance Law promulgated on October 17, 2018;
  • Circular 14/2014/TT-BYT regulating the transfer of medical examination and treatment facilities promulgated by the Minister of Health on April 14, 2014;
  • Circular 40/2015/TT-BYT regulating registration for initial medical examination and treatment under health insurance and transfer of medical examination and treatment under health insurance was promulgated by the Minister of Health on November 16, 2015;
  • Circular 30/2020/TT-BYT guiding Decree 146/2018/ND-CP guiding the Health Insurance Law promulgated by the Ministry of Health on December 31, 2020.
