A doctor is a practitioner in the medical field, with a scope of work and responsibilities that directly impacts human health and life. Whether working in a hospital, clinic or any other medical facility, doctors must meet qualifications, practice capacity, etc. and must be granted a medical practice certificate.
Working without doctor medical practice certificate is one of the prohibited acts according to the provisions of the 2009 Law on Medical Examination and Treatment with a fine up to VND 40 million, with requirement of full return of illegal profits from violations.
1. Conditions for issuance of doctor medical practice certificate
To be granted medical practice certificate, a doctor must meet all conditions, including:
– Having one of the following diplomas or certificates appropriate to the field of practice:
+ Professional diploma related to health issued or recognized in Vietnam;
+ Certificate of being a physician;
+ Certificate of being a person who has a family medicine recipe or a family medicine treatment method.
– Having written confirmation of the practice process.
(except in the case of a physician, a person with a family medicine recipe or a family medicine method)
– Having a certificate of good health to practice medical examination and treatment.
– Not in the case of being banned from practicing or doing work related to medical or pharmaceutical expertise according to a court judgment or decision; are being prosecuted for criminal liability; are serving a criminal sentence, a criminal court decision or a decision to apply administrative measures such as being sent to an educational facility or medical treatment facility; are currently being disciplined in the form of a warning or higher related to medical examination and treatment expertise; loss or limitation of civil act capacity.
In addition, for foreigners practicing in Vietnam, Vietnamese residing abroad need to meet a number of additional specific conditions:
– Meeting requirements on language use in medical examination and treatment according to the provisions of the Law.
– Having a criminal record confirmed by the competent authority of the host country.
– Having a work permit issued by a competent state agency on labor of Vietnam according to the provisions of labor law.
2. Procedures for issuance of doctor medical practice certificate
– Step 1: Individual submits application to the state agency with processing authority (Ministry of Health or Department of Health) by direct submission or by post.
– Step 2: The application receiving agency issues the application receipt to the applicant.
– Step 3: Within 20 days from the date recorded on the application receipt slip, the application receiving agency will appraise the application and issue an appraisal record.
– Step 4: Issue practice certificate.
+ In case the application is valid, within 10 working days from the date of the appraisal record, the agency receiving the application shall issue or re-issue the practicing certificate.
+ In case of invalid documents:
Within 05 working days from the date of the appraisal record, the dossier-receiving agency shall send a written notice of dossier completion.
The applicant for a practicing certificate must amend and supplement according to the contents recorded in the document and send additional documents to the receiving agency. The dossier-receiving agency sends an additional dossier receipt form to the applicant for doctor medical practice certificate.
The dossier-receiving agency continues to carry out the procedures according to steps 1, 2, 3. In case the additional dossier is still invalid, the dossier-receiving agency continues to guide the applicant to issue and re-issue the certificate. Just practice completing documents.
If at the end of the 60-day period from the date the dossier-receiving agency issues a written request, but the applicant for a practicing certificate does not supplement or amend the dossier, the dossier and procedures must be repeated from the beginning of the issuance or re-issuance procedure of doctor medical practice certificate.

3. Subjects who are required medical practice certificate other than doctors
Subjects practicing in the field of medical examination and treatment required to have a medical practice certificate include:
– Doctors, physicians;
– Nurses;
– Midwives;
– Technicians;
– Herbalists;
– Owners of family herbal remedies or treatment methods.

- Law on Medical Examination and Treatment 2009;
- Decree 109/2016/ND-CP regulates the issuance of practice certificates to practitioners and operating licenses to medical examination and treatment facilities;
- Decree 117/2020/ND-CP regulates sanctions for administrative violations in the health sector.
