PROCEDURES FOR ABANDONED CHILD ADOPTION

Abandoned children have the right to be adopted and ensure a full family life for their development. From the date of adoption, the adoptive parents and adopted child will have full rights and obligations of parents and child. So how are the procedures for abandoned child adoption carried out?

1. What conditions must be met for abandoned children to be adopted?

Abandoned child are child whose biological parents cannot be identified, can be adopted and abandoned child adoption are encouraged according to current law.

Noted, a person can only be adopted by a single person or by both husband and wife.

2. Why is it necessary to implement the procedures of abandoned child adoption?

According to current law, the registration and full implementation of procedures of abandoned child adoption will establish an official legal relationship and ensure full legal rights and interests in the relationship between parents and children. Legal consequences of abandoned child adoption:

– From the date of handover and receipt of the adopted child, the adoptive parents and adopted child have full rights and obligations of parents and child; The adopted child and other members of the adoptive parents’ family also have rights and obligations towards each other according to the provisions of law.

– Abandoned child can have their names changed at the request of their adoptive parents. Changing name of an adopted child aged from 9 years must be approved by the child.

– The ethnicity of an adopted child who is an abandoned child can be determined according to the ethnicity of the adoptive father and adoptive mother.

3. What are the procedures of abandoned child adoption?

a. Step 1: Documents preparation for abandoned child adoption

– The adopter’s dossiers includes:

+ A written request for adoption;

+ A copy of the passport or identity card or a valid substitute paper;

+  The judicial record sheet;

+ Written certification of the marital status;

+ A health certificate;

+ a written certification of family circumstances and housing and economic conditions.

Dossiers of persons introduced for domestic adoption:

+ The birth certificate;

+ A health certificate granted by a district-or higher-level health agency;

+ Two photos of the whole body looking straight, taken within the past 6 months;

+ A record of certification made by the commune-level People’s Committee or police of the place in which the child is abandoned, for abandoned children; 

+ The receipt decision, for children in a nurturing center.

The registration and full implementation of procedures of abandoned child adoption will establish an official legal relationship and ensure full legal rights and interests.

b. Step 2: Examining, verifying records and confirming that children are eligible for abandoned child adoption

The competent authority shall examine the documents and collecting opinions from the guardian or child according to regulations within 10 days from the date of receipt of complete and valid documents.

In case an abandoned child needs to be verified, the competent authority will carry out the verification.

c. Step 3: The competent authority decides to adopt the child and organizes the adoption

When it is deemed that the adoptive person and the person introduced for adoption meet the prescribed conditions, the competent agency shall organize the adoption registration, award the adoption certificate, and organize the adoption and recorded in the civil status book within 20 days from the date of consent in Step 2.
