PROCEDURES FOR APPLYING FOR A TEMPORARY RESIDENCE CARD FOR FOREIGN INVESTORS IN VIETNAM

The investment temporary residence card (DT category) is an optimal long-term residence solution that serves as a substitute for a visa for foreign investors and representatives of foreign organizations making capital contributions and conducting business in Vietnam. Issued based on the value of the capital contribution recorded in the Investment Registration Certificate or Enterprise Registration Certificate, the DT temporary residence card enables investors to reside in Vietnam with peace of mind and proactively manage their production and business activities.

CASES ELIGIBLE FOR INVESTMENT TEMPORARY RESIDENCE CARDS AND THEIR VALIDITY PERIODS

Under current regulations, temporary residence cards issued to foreign investors and representatives of foreign organizations investing in Vietnam are classified into the following categories with corresponding validity periods:

1. DT1 Temporary Residence Card (Maximum validity: 10 years)
Eligible persons: Foreign investors in Vietnam and representatives of foreign organizations investing in Vietnam.

Capital investment/Investment sector or location requirements: Investors with a capital contribution of VND 100 billion or more, or those investing in investment incentive sectors or investment incentive locations as decided by the Government.

2. DT2 Temporary Residence Card (Maximum validity: 5 years)

Eligible persons: Foreign investors in Vietnam and representatives of foreign organizations investing in Vietnam.

Capital investment/Investment sector requirements: Investors with a capital contribution of from VND 50 billion to less than VND 100 billion, or those investing in sectors encouraged for investment and development as decided by the Government.

3. DT3 Temporary Residence Card (Maximum validity: 3 years)

Eligible persons: Foreign investors in Vietnam and representatives of foreign organizations investing in Vietnam.

Capital investment requirement: Investors with a capital contribution of from VND 3 billion to less than VND 50 billion.

DOCUMENTS REQUIRED FOR APPLYING FOR A TEMPORARY RESIDENCE CARD

To apply for a temporary residence card for a foreign investor, the sponsoring organization or individual must prepare the following documents in accordance with applicable regulations:

– The foreign investor’s original passport

– The Investment Registration Certificate or Enterprise Registration Certificate, together with documents proving the applicant’s status as an investor- Documents proving the investor’s capital contribution

– Temporary residence registration confirmation-

– Passport-sized photographs: 02 photos measuring 2 x 3 cm

– Required immigration forms:

+ Form NA6: Written application for a temporary residence card, signed and stamped by the sponsoring enterprise/organization

+ Form NA7: Written application for sponsorship for a temporary residence card, signed by the individual sponsor

+ Form NA8: Application form for the issuance of a temporary residence card for a foreigner, directly signed by the investor

PROCEDURE AND PROCESSING TIME

Place of submission: The inviting or sponsoring agency/organization must directly submit the application for a temporary residence card to the Immigration Department under the Ministry of Public Security or the Immigration Division of the provincial-level Police Department where the enterprise has its head office.

Processing time: Within 05 working days from the date of receipt of a complete and valid application dossier, the immigration authority will review and process the application and issue a temporary residence card to the foreigner.

Validity of the temporary residence card: The validity period of the temporary residence card must be at least 30 days shorter than the remaining validity of the passport.
