PROCEDURES OF BUSINESS LOCATION ESTABLISHMENT

After the Covid-19 pandemic, the economy is gradually recovering and growing strongly. Enterprises gradually restored business operations, as well as expanded and developed their businesses. In that trend, business location establishment is one of the forms that many businesses are interested in and choose. So what are the procedures of business location establishment?

What is business location?

According to the Enterprise Law 2020, business location is the place where an enterprise conducts specific business activities.

Enterprises can establish business location in the same province or another province. Upon business location establishment, the enterprise must send a notice to the business registration agency.

Business location can be directly under the enterprise or under a branch.

Documents of notice on business location establishment

In case an enterprise wants to carry out business location registration procedures, the following documents are required:

– Notice of business location establishment;

– Power of attorney for the individual/organization submitting the application;

– Certified copy of ID card/ID card/Passport of the individual submitting the application.

Method of documents submission for business location establishment

After preparing the complete documents, enterprises can submit in one of two ways: online or in person.

– Submitting in person: Enterprises submit documents at the Business Registration Office – Department of Planning and Investment of the province/city where the business location is located.

– Submitting online: Enterprises submit documents at the National Business Registration Portal.

Procedures and deadlines for processing documents

Within 10 days from the date of decision on business location establishment, the enterprise sends a notice of business location establishment to the Business Registration Office where the business location is located.

The Business Registration Office will consider and resolve within 03 working days from the date of receipt of valid documents.

If the application is valid, the Business Registration Office will issue the Certificate for enterprises.

Notable contents when establishing business location

Requirements for business location name:

– Name of business location must be written with letters in the Vietnamese alphabet, the letters F, J, Z, WITH, numbers and symbols;

– Name of the business location must include the business name followed by the phrase “Business location”;

– Name of the business location must be written or posted at the business location’s headquarters.
