TRADEMARK TRANSFER, DOCUMENTS AND PROCEDURES

Trademark transfer is the transfer of ownership of the trademark by the owner to another individual or organization. The trademark transfer is carried out in the form of signing an Industrial Property Rights Transfer Contract. The transfer of rights to a trademark is intended to connect a party that no longer has a business need and a party that has a business need but does not have the conditions to create and build a brand. Brand and trademark transfer activities bring benefits to both the owner, the transferee and society in general.

1.         Transfer of trademark rights

a.         A trademark is a sign used to distinguish goods and services of different organizations and individuals. Trademark owners have the exclusive right to use them during the protection period specified in the protection certificate throughout the territory of Vietnam. Other organizations and individuals who want to use a trademark under protection for commercial purposes must obtain permission from the trademark owner.

c.         Representative completes trademark transfer procedures for clients  

–           After signing the service contract, we prepare the trademark transfer documents for the clients;

–           Representing clients to submit trademark transfer documents at the Intellectual Property Department;

–           Representative tracks documents and notifies clients of the results of submitted documents;

–           Representing the clients in receiving the trademark transfer certificate at the Intellectual Property Office;

–           Prepare official response letters when trademark disputes arise with other application owners.
