APPLICATION FOR RE-ISSUANCE OF LOST RED BOOK

Losing red book is an undesirable situation, but sometimes it still happens due to many reasons such as loss during use, fire, or natural disaster. Losing red book can cause many problems in proving land ownership and carrying out related transactions. Then, what should be paid attention to when applying for re-issuance of lost red book?

What is red book?

Red book or Certificate (Certificate of land use rights, ownership of housing and other assets attached to land) is a legal document for the State to confirm land use rights, ownership of housing, other assets legally attached to land of people with land use rights, house ownership rights and ownership of other assets attached to land.

According to current laws, a red book includes a blank certificate (one sheet has 04 pages, printed with a lotus-pink bronze drum pattern) and an additional page with a white background.

What procedure should be implemented upon losing red book?

In case of loss of red book, the owner must declare the loss to the Commune-level People’s Committee where the land is located and carry out procedures to request the re-issuance of the red book.

What documents are required for application of re-issuance of lost red book?

When submitting an application of re-issuance of lost red book, the following documents need to be provided:

– Application for re-issue of lost red book;

– Confirmation from the Commune People’s Committee that the notice of loss of red book has been listed within 15 days; or Confirmation of the Commune People’s Committee regarding natural disaster or fire in case of loss of the Certificate or Additional page of the Certificate due to natural disaster or fire.

What should be kept in mind upon application of re-issuance of lost red book?

People with demand must implement the procedures to request re-issuance of lost red books after 30 days from the date of posting notice of loss of red books at the headquarters of the commune-level People’s Committee.

What documents received after completing the procedure?

The results of the procedures on re-issuance of lost red book include:

– To be recorded in the cadastral book and make records for the State to manage.

– Certificate.

  • Circular 24/2014/TT-BTNMT on cadastral records issued by the Minister of Natural Resources and Environment.
