CONDITIONS FOR ISSUANCE OF THE ELIGIBILITY CERTIFICATE FOR CONSTRUCTION DESIGN (ASSESSMENT), CLASS I

Certificate of eligibility for construction activities is a certification document issued by competent state agencies to organizations that meet all conditions when participating in construction activities, according to the provisions of the Construction Law and implementation manuals. Corresponding to each capacity class, the corresponding operating and licensing conditions also have differences to be noted. Accordingly, organizations must fully satisfy the conditions to be issued eligibility certificate for design (assessment) Class I when participating in corresponding activities.

1.      Conditions for issuance of eligibility certificate for construction design (assessment) Class I

Organizations participating in construction design (assessment) activities with the capacity of Class I must satisfy the corresponding conditions:

–           The individual working as a president or chairperson in charge of construction design (assessment) of design-related disciplines shall obtain a Rank-I practicing certificate or an architecture practicing certificate for architecture design services/architecture verification issued under the Law on Architecture in conformity with his/her specialized field;

–           The individual involved in construction design (assessment) shall have his/her expertise relevant to the field and work type for which an eligibility certificate is sought;

–           The organization has designed or appraised the design of at least 01 Class I work or higher or 02 Class II works or higher of the same type.

2.         Procedures for issuance of eligibility certificate for construction design (assessment) Class I

Organizations with demand to apply for a eligibility certificate for construction design (assessment) Class I shall follow the order and procedures as follows:

–           Step 1: Application submission

The organization submits 01 set of application documents for the issuance eligibility certificate for construction design (assessment) Class I as prescribed. Method of submission: through online network; post office; or submit directly to the competent authority.

–           Step 2: Dossiers handling

Competent agency handle the dossiers that have been fully and duly submitted.

Time for processing:

+          In case of first-time issuance of eligibility certificate: 20 working days.

+          In case of adjustment, amendment, supplement or extension of eligibility certificate: 20 working days.

+          In case of re-issue of capacity certificate: 10 working days.

In case the dossier is incomplete or invalid, the agency competent to issue the eligibility certificate must notify once in written to the applicant organization within 5 working days from the date of receiving the application for the eligibility certificate.

3.         Dossiers for implementation

Dossier of application for a eligibility certificate for construction design (assessment) Class I:

–           An application form for a eligibility certificate;

–           Decision on establishment of organization in case of establishment decision;

–           Declaration on the practice certificate code in the application for a certificate of capacity for individuals who have been granted practice certificates of titles requiring a practicing certificate.

–           Contract and Minutes of acceptance of the work performed according to the declared contents.
