FOREIGN LABORS CHANGING THEIR PASSPORTS MUST AMEND WORK PERMIT?

Work permit is a mandatory requirement for foreigners to legally work in Vietnam. Therefore, any changes to the personal information on their passports, such as a new passport number, passport expiration, or passport reissuance, may directly affect the validity of their work permit.

When is it necessary to amend work permit?

Foreign labors may apply for the reissuance of work permit while their existing work permit remains valid in the following cases:

– The work permit is lost, torn, faded, or physically damaged to the extent that it can no longer be used.

– There are hanges to the full name, nationality, or passport number stated on the work permit.

Where a valid work permit holder changes their passport, resulting in changes to the passport number or other personal information, the employing enterprise is required to apply for the reissuance of the work permit to ensure that the information remains consistent and compliant with applicable regulations.

Application dossier for work permit reissuance due to passport replacement

The enterprise must prepare one application dossier, including:

– A written application for the reissuance of work permit;

– 02 photographs measuring 4 x 6 cm, with a white background, taken within the last 06 months;

– The original valid work permit;

– The new passport.

Procedures for the reissuance of work permit for foreign workers

– The enterprise submits the application to the local Public Administration Service Center in the locality where the foreign worker is employed. The application may be submitted directly, by post, through an authorized representative, or via a service provider.

– The Public Administration service center receives and transfers the application to the competent authority through the one-stop-shop mechanism or the National public service portal.

– The competent authority reissues the work permit within 03 working days from the date of receipt of a complete and valid application. In the event of refusal, the authority must provide a written response stating the reasons.

Notes on the validity period of the reissued work permit

The validity period of the reissued work permit is equal to the remaining validity period of the previously issued work permit after deducting the period during which the foreign worker has worked up to the date of application for reissuance.
