PENALTIES FOR OVERSTAYING TEMPORARY RESIDENCE CARD

Failure to renew a temporary residence card on time can subject foreign nationals to penalties under the law. Penalties for overstaying temporary residence cards are imposed to ensure orderly and effective management of foreigners’ residence in Vietnam, as well as to prevent unlawful stays. The fines vary depending on the severity of the violation.

What is temporary residence card?

A temporary residence card is a document issued by the immigration authority or a competent agency of the Ministry of Foreign Affairs, allowing foreign nationals to reside in Vietnam for a specified period. It serves as a substitute for a visa.

Depending on the purpose of entry, foreign nationals may be issued temporary residence card with specific codes and validity periods.

Once a temporary residence card expires, procedures for the issuance of a new card must be initiated.

Penalties for foreign nationals with overstaying temporary residence card

Based on the severity of the violation committed by the foreign national, the applicable penalties are prescribed as follows:

Overstaying temporary residence card for less than 16 days:

Foreign nationals using an expired temporary residence card in Vietnam for less than 16 days without authorization from the competent authority may face a fine ranging from VND500,000 to VND2,000,000.

Overstaying temporary residence card from 16 to less than 30 days:

For overstaying temporary residence card between 16 and less than 30 days without permission from the competent authority, foreign nationals may be subject to a fine ranging from VND3,000,000 to VND5,000,000.

Overstaying temporary residence card from 30 days to less than 60 days:

Foreigners using expired temporary residence certificates, extensions, cards, or failing to renew permanent residence card in Vietnam for a period of 30 to less than 60 days without authorization from competent authorities are subject to a fine ranging from VND5,000,000 to VND10,000,000.

Overstaying temporary residence card from 60 days to less than 90 days:

Foreigners using expired temporary residence certificates, extensions, cards, or failing to renew permanent residence cards for a period of 60 to less than 90 days without authorization from competent authorities are subject to a fine ranging from VND10,000,000 to VND15,000,000.

Overstaying temporary residence card from 90 days:

Foreigners using expired temporary residence certificates, extensions, cards, or failing to renew permanent residence cards from 90 days without authorization from competent authorities are subject to a fine ranging from VND15,000,000 to VND20,000,000.

In addition to fines, foreign nationals violating regulations by overstaying their temporary residence cards may also face deportation.

  • Decree 144/2021/ND-CP regulating sanctions for administrative violations in the field of security, order and social safety; prevent and combat social evils; fire protection and prevention; rescue and salvage; prevent and combat domestic violence.
