PROCEDURES FOR ISSUANCE OF TEMPORARY RESIDENCE CARD FOR FOREIGN EMPLOYEES

Foreigners with a work permit or a work permit exemption certificate with a term of 12 months or more in accordance with regulations are entitled to be granted temporary residence card, with the duration of the temporary residence card depends on the validity period of the work permit.

A temporary residence card is similar to a long-term Visa issued by a competent authority to foreigners in order to allow foreigners to legally reside in the territory of Vietnam for a definite period. Temporary residence cards will have different types depending on the purpose of foreigners in Vietnam.

So, what how is the procedures for issuance of temporary residence card implemented?

1.         Conditions to be applied for issuance of temporary residence card

– Passport validity must be at least 2 years.

– The visa being used in Vietnam by foreigners must be for the right purpose (the visa must have the symbol LD, LD 1, LD 2 or DN, DN1, DN2) sponsored by the company before.

– In case of conversion from a visa or other temporary residence card to a temporary working residence card, a work permit or work permit exemption certificate and other appropriate conditions as prescribed by law is required.

– Have a work permit or work permit exemption certificate with a validity of at least 1 year (full 12 months)

2.         Competent agency for issuance of temporary residence card

Immigration Department – Ministry of Public Security or Immigration Department of the province/city where the company with foreigners working locates.

3.         Implementation procedure for issuance of temporary residence card

– Step 1: Preparing documents;

– Step 2: Submitting application for temporary residence card at competent agency.

– Step 3: The competent agency issues temporary residence card to foreigners within 05 working days from the date of submission of valid documents.

4.         Duration of temporary residence card

According to the labor law, the maximum term for a work permit for foreigners is 2 years, so foreigners can apply for a temporary residence card in Vietnam with a maximum term of 2 years as prescribed.

5.         Dossier to apply for a temporary residence card

– A written request from the inviting entity;

– A declaration bearing a picture;

– The passport;

– Papers proving the purpose of residence.

6.         Procedure results for issuance of temporary residence card

Foreign workers will be granted a temporary residence card with the term on the work permit. In case the passport is not valid for 2 years, the employee will only be issued until 30 days before the passport expires.
