PROCEDURES FOR ISSUANCE OF ELIGIBILITY CERTIFICATE  FOR CONSTRUCTION EXECUTION CLASS II

Certificate of eligibility for construction activities is a document of certification issued by competent state agencies to organizations that meet all conditions when participating in construction activities, in accordance with the provisions of the Construction Law. Then, in order to be issued eligibility certificate for construction execution Class II, what are the procedures that an organization needs to carry out?

1.         Which activities require a construction activity certificate?

Each organization engaging in construction activities in the following fields must meet conditions and obtain eligibility certificate:

–           Construction survey;

–           Construction planning;

–           Design and design assessment;

–           Construction project management consulting;

–           Construction execution;

–           Construction supervision;

Except for:

–           Performing project management tasks of specialized construction investment project management boards and regional construction investment project management boards (except for project management consultancy for other projects); Project Management Board invests in the construction of a project; The investor organizes the implementation of project management;

–           Designing, supervising and executing fire prevention and fighting in accordance with the law on fire prevention and fighting;

–           Designing, supervising and construction executing communication and telecommunications systems in the works;

–           Designing, supervising and executing construction finishing works such as plastering, tiling, painting, door installation and other similar works that do not affect the load-bearing structure of the work; supervision, interior construction works;

–           Participating in construction activities for separate houses; green parks, public lighting works; telecommunications signal transmission cable line; the project has only the works mentioned at this point;

–           Carrying out construction activities of foreign organizations under construction operation permits.

2.         Conditions for issuance of eligibility certificate for construction execution Class II

Organizations participating in construction execution with the capacity of Class II must satisfy the corresponding conditions:

–           The individual working as a site manager shall satisfy requirements applied to a Class-II or higher site manager relevant to his/her specialized field;

–           The individual in charge of execution of a specialized field shall obtain a bachelor’s degree or Level 5 of VQF Advanced Diploma relevant to his/her tasks, and has a work duration of at least 01 year and 03 years with respect to the holder of the bachelor’s degree and Level 5 of VQF Advanced Diploma respectively;

–           The organization shall be capable of providing sufficient machinery and equipment meeting construction execution requirements that match its tasks;

–           The organization has directly executed tasks of a work item, work or component (in case of specialized construction) relevant to the requirements of the certificate of at least 01 Class I work or higher or 02 Class II works or higher of the same type;

–           The organization has directly installed equipment of the work item or work relevant to the requirements of the certificate of at least 01 Class II work or higher or 02 Class III works or higher of the same type for the installation of equipment to the work.

3.         Dossier for issuance of eligibility certificate for construction execution Class II

Dossier of application for eligibility certificate for construction execution Class II:

–           An application form for eligibility certificate;

–           Decision on establishment of organization in case of establishment decision;

–           Declare the practice certificate code in the application for a certificate of capacity for individuals who have been granted practice certificates of titles requiring a practicing certificate.

–           Competency certificate already issued by a competent authority in case of request for adjustment of the qualification certificate class;

–           Contract; Minutes on acceptance of completion of  construction works or work parts (in case of specialized construction work) have been made according to the declared contents.

4.         Procedures for certificate issuance

Organizations wishing to apply for eligibility certificate for construction execution Class II shall follow the order and procedures as follows:

–           Step 1: Application submission

The organization submits 01 set of application documents for the issuance eligibility certificate for construction design (assessment) as prescribed. Method of submission: through online network; post office; or submit directly to the competent authority.

–           Step 2: Dossiers handling

Competent agency handle the dossiers that have been fully and duly submitted.

Time for processing:

+          In case of first-time issuance of eligibility certificate: 20 working days.

+          In case of adjustment, amendment, supplement or extension of eligibility certificate: 20 working days.

+          In case of re-issue of capacity certificate: 10 working days.

In case the dossier is incomplete or invalid, the agency competent to issue the eligibility certificate must notify once in written to the applicant organization within 5 working days from the date of receiving the application for the eligibility certificate.
