PROCEDURES FOR AMENDMENT OF THE CERTIFICATE OF INCENTIVES FOR SUPPORTING INDUSTRY PRODUCT MANUFACTURING PROJECTS

During the implementation of supporting industry product manufacturing projects, enterprises may experience changes in scale, location, or business activities. In such cases, the procedure for adjusting the Certificate of Incentives is necessary to ensure continued entitlement to preferential policies and to comply with current legal regulations.

Applicable cases

The Certificate of Incentives for supporting industries shall be amended when there is any change to the information stated in the Certificate of Incentives.

Application dossier

• A written request for amendment to the Certificate of incentives (Form No. 05 in Appendix III enclosed with the Decree No.205/2025/ND-CP)

• The original or a copy of documents and materials serving as the basis for proving the amendment to the Certificate of incentives

Competent authorities

The authority competent to issue the Certificate of Incentives shall also be responsible for handling the amendment thereof.

• The province-level People’s Committee shall certify incentives for projects producing supporting-industry products on the List of supporting-industry products prioritized for development of small- and medium-sized enterprises

• The Ministry of Industry and Trade shall certify incentives for projects producing supporting-industry products on the List of supporting-industry products prioritized for development of other enterprises

Procedures

• Enterprises shall submit 01 set of the application dossier directly, by post, or online via the Public Service Portal to the competent authority.
• The competent authority shall review the dossier within 05 working days. In case the dossier is incomplete or invalid, the competent authority shall issue a written request for supplementation and completion.
• Within 20 days from the date of receiving the request for supplementation, the enterprise shall supplement and complete the dossier. Upon the expiry of this time limit, if the enterprise does not supplement or fails to fully, validly supplement the dossier, the competent authority shall suspend the processing of the application.
• After the enterprise submits a complete and valid dossier, the competent authority shall conduct an appraisal. In cases it is necessary to clarify the information, the competent authority may carry out an on-site inspection at the enterprise’s premises or issue a written request for explanation.
• Within 30 days from the date of receiving a complete and valid dossier, satisfactory explanations and acceptable inspection results, (if any), the competent authority shall issue a written notification of the results of the amendment of the Certificate of Incentives.
